These Terms & Conditions (“Terms”) govern your access to and use of the website duanezingale.com (the “Site”), operated by Legacy Catalyst, a service of Wonder Family LLC (“Legacy Catalyst,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Who We Are

Legacy Catalyst is a service of Wonder Family LLC. Legacy Catalyst provides digital marketing and advertising services to business clients, and operates FCGclaw, an internal application used to create, manage, and report on advertising campaigns on Meta platforms (Facebook, Instagram) on behalf of those clients.

2. About the Site and Our Services

The Site is an informational website describing Legacy Catalyst and its services. Nothing on the Site is an offer or guarantee of any particular result.

Our advertising and marketing services are provided to business clients under separate written agreements (such as a service agreement, statement of work, or engagement letter). Those separate agreements — not these Terms — govern the scope, fees, deliverables, and obligations of any client engagement. In the event of a conflict between these Terms and a signed client agreement, the signed client agreement controls with respect to that engagement.

3. Eligibility

The Site is intended for business use by individuals who are at least 18 years old and able to form a binding contract. By using the Site, you represent that you meet these requirements. The Site is not directed to children.

4. Acceptable Use

When using the Site, you agree not to:

  • Use the Site in any way that violates applicable law or regulation;
  • Attempt to gain unauthorized access to the Site, its servers, or any connected systems;
  • Interfere with or disrupt the operation, security, or integrity of the Site;
  • Introduce malware, viruses, or other harmful code;
  • Scrape, harvest, or collect data from the Site through automated means without our prior written consent; or
  • Use the Site to transmit unsolicited or unauthorized advertising, spam, or other solicitation.

We may suspend or terminate access to the Site, in whole or in part, at any time and without notice, for conduct we reasonably believe violates these Terms or is harmful to us, our clients, or others.

5. Intellectual Property

Unless otherwise noted, the Site and its contents — including text, graphics, logos, images, and design — are owned by or licensed to Legacy Catalyst / Wonder Family LLC and are protected by intellectual property laws. You may view and use the Site for your own informational purposes, but you may not copy, reproduce, republish, distribute, or create derivative works from Site content without our prior written permission.

“Legacy Catalyst,” “FCGclaw,” and related names and logos are marks of Wonder Family LLC. Other product and company names referenced on the Site are the property of their respective owners.

6. Client Advertising Services and Third-Party Platforms

Our advertising services operate on top of third-party platforms, including Meta Platforms, Inc. (Facebook, Instagram). Use of those platforms is subject to the platforms’ own terms and policies, and we do not control and are not responsible for those platforms.

Advertising and marketing involve factors outside our control, including platform algorithms, auction dynamics, audience behavior, and market conditions. We do not guarantee any specific results, including impressions, clicks, leads, conversions, sales, revenue, or return on ad spend. Any examples, estimates, or projections are illustrative only and are not a promise of performance.

7. Third-Party Links

The Site may contain links to third-party websites or resources. We provide these links for convenience only and do not endorse and are not responsible for the content, products, or practices of any third-party site. Accessing third-party sites is at your own risk and subject to their terms and privacy policies.

8. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and share information, including information processed through FCGclaw on behalf of our clients. By using the Site, you acknowledge the practices described in the Privacy Policy.

9. Disclaimers

The Site and its contents are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any information on the Site is accurate, complete, or current.

10. Limitation of Liability

To the fullest extent permitted by law, Legacy Catalyst, Wonder Family LLC, and their owners, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the Site, whether based in contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site will not exceed one hundred U.S. dollars (US $100). Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Legacy Catalyst, Wonder Family LLC, and their owners, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or your violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Alabama, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Mobile County, Alabama, and you consent to personal jurisdiction and venue there.

13. General Provisions

Severability. If any provision of these Terms is found unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement. These Terms, together with our Privacy Policy and any separate written client agreement referenced in Section 2, constitute the entire agreement between you and us regarding the Site, and supersede any prior or contemporaneous understandings on that subject.

No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing to be effective.

Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Force Majeure. We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disaster, war, terrorism, labor disputes, internet or utility failures, or governmental action.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
